Do you own a PV plantfrom 2009–2010?
Thanks to LEX OZE III, you can gain a second source of income without losing subsidies.
Act No. 87/2025 Coll. (LEX OZE III), effective from August 1, 2025, allows operators of photovoltaic power plants with a supported feed-in tariff to add battery storage without losing their existing support for the first time.Free ConsultationEffective Date

LEX OZE III is effective
from August 1, 2025.
Legal Basis
Section 11a(8)
The new provision of the Act
allows operating BESS
without losing subsidies.
Target Group
PV Plants 2006–2012
Power plants with a supported
feed-in tariff.
What does the law actually allow?
Energy Act, Section 11a(8)
Electrical energy supplied from an accumulation facility to the electricity grid is not considered electricity produced from a supported energy source...
Full text of the Act (CZ)Practical consequence: the part of the PV plant intended for drawing feed-in support (green bonus) remains separately measured, and the battery operates in parallel as an independent device. The right to the feed-in tariff arises based on production from the PV plant measured by the producer's meter — not according to where the energy ultimately flows.
For PV plant owners from 2006–2012, this means that by building a BESS, they will not lose the feed-in tariff they fixed for 20 years.
Why not wait until the support ends?
Prepare the project in peace
Project preparation, permitting, and connection take months.
Start earning earlier
BESS can generate new income even before the support ends.
Avoid market congestion
After the support ends, a large number of power plants will seek modernization.
Increase PV value
A modernized power plant has a higher market value and better options for further operation.
What we will arrange for you
Legal Analysis
We will check if your power plant is suitable for expansion under LEX OZE III.
Technical Design
We will design the optimal size and configuration of the battery storage.
Project Documentation
Complete project preparation including all requirements.
Administration
Communication with the distributor, authorities, and other institutions.
SolarMon EMS
Delivery of our own system for control, monitoring, and trading.
Trading Strategy
We will propose a method for entering the market and optimizing revenues.
SOLARMON GRID
We will trade your energy. Aggregation and commercial dispatch in your local distribution systems (LDS).
What you specifically get
01.
Subsidies Preservation
The existing feed-in tariff (green bonus) is preserved for the entire duration of the support — production from the PV plant is measured separately, and support is not compromised.
02.
Second Source of Income
Battery storage can provide ancillary services (FCR, aFRR, mFRR) and trade on markets, creating a new stable source of income.
03.
Higher PV Value
A modernized power plant is more flexible, competitive, and has a higher market value even after the support ends.
